On December 21, Hudson County Superior Court Judge Christine Farrington issued a summary judgment regarding the Galaxy's appeal of the North Bergen Planning Board approval of the controversial Appleview development - sending it back to the municpal board for review.

The judge ruled in favor of the Galaxy reversing the North Bergen Planning Board's previous approval citing what she referred to as "arbitrary", "capricious" and "unreasonable" actions taken by the North Bergen Planning Board, which essentially delegated it's own responsibility of ensuring the safety of the project to the developer - a major conflict of interest.

The Appleview development is a proposed 59-unit residential complex on River Road that has raised the ire of local residents due to its distance (20 ft) from a major TransCo pipeline that supplies natural gas to New York City.  At issue is the safety of surrounding developments should the pipeline be accidentally disturbed during or after construction at the property, which requires drilling to remove sections of the Palisades.  The development was approved in March by the North Bergen Planning Board despite protests from residents and expert testimony citing safety concerns.

Below is an excerpt of the judgement:

Unbelievable! Just another example of this town putting developers first and residents second, if not last!

Absolutely! It's obvious they only care about their fri[censored]s! Who cares about the residents that may lose their lives if this developer decides to cut some corners. Thank you Judge Farrington for being a straight shooter!

Not surprising. The only thing surprising is this Judge's comments about it and the fact that no other news outlet really picked up on them. I doubt any other Judge in Hudson County would have had the courage to call them out on it. They're all afraid of Little Nicky.

the building inspectors and the planning board are all paid of by Builders like K HOV. and have no regard for homeowners who are living under peril. NOTHING NEW IN NORTH BERGEN.. JUST business as usual.

Yes the building inspectors are paid off A perfect example is the owner of 1208 13th St North Bergen NJ 07047 has 2 illegal apartments that he rerents out again and again one in the basement and one in the attic and the building inspector states it is ok because of his 4 legal apartments Since When? The owner Randolph Pippin Jimenez house 1208 13th ST North Bergen NJ foreclosed in Nov 2013 by PNC Bank North Bergen NJ and one month later after the bank foreclosure the same owner refinanced that house by dropping his last name of Jimenez and going by Randolph Pippin and got a relative to go on the ownership Osvaldo Castillo Isn't refinancing a foreclosed property against the law? City hall knows about it and does nothing about it Why not?
