A 5-year-old North Bergen girl suffered a head injury after being pushed by another student and school officials put her on a bus to another school rather than getting her immediate medical attention, an attorney for the girl's family said.

The attorney, Robert B. Linder of Englewood, said a notice of tort is being filed today in anticipation of the filing of a lawsuit. Among those expected to be name in the suit are the township, the school district and the superintendent of schools.

"There was obviously a lack of supervision of the children and they should not have put her on a bus after the incident, 911 should have been called immediately,” Linder said.




On Dec. 20, 5-year-old Kaorie Spearman was at Lincoln Elementary School waiting in line to board a bus to be taken to Horace Mann School when she was pushed to the ground by another kindergarten student, said Linder, adding that she struck her head and face on the ground.

Kaorie suffered a serious injury to her face, a closed head injury, a cerebral hematoma and a concussion, the notice of tort says, adding that despite her injuries, she was placed on the bus to Horace Mann School, 20 blocks away.

When Kaorie arrived at Horace Mann, 911 was called and she was taken by ambulance to Palisades Medical Center, where she was admitted for treatment and released two days later, Linder said.

Kaorie remains under the care of a neurologist, Linder said, adding that she still suffers head pain, she has trouble sleeping, lacks focus, is lethargic and somewhat disoriented.

"She is not herself,” he said.

North Bergen spokesman Philip Swibinski said “Without seeing the details of the potential suit we cannot comment about it at this time. Attorneys for the township and the Board of Education will review the matter and react accordingly.”

The personal injury lawsuit seeks compensation for pain and suffering. It will name as defendants North Bergen, the township board of education, the superintendent of schools, Lincoln Elementary School and Horace Mann School, Linder said. 

After filing the notice of tort there is a six month waiting period before the suit can be filed.

“It has been horrendous on the family, particularly at this time of the year – it is terrible,” said Linder. “It has been a nightmare for Kaorie and her family.”
